As parents/guardians enrolling the student(s) identified below in Trinity Classical Academy (“Trinity”), I/we understand that Trinity is governed by a self-elected school board (“Trinity Governing Board”), and provides private, Christian education for Kindergarten through 12th grade and I/we am/are in agreement with its purposes and statement of faith as set forth in the Trinity Student-Parent Handbook, a copy of which has been provided to me/us. I/we further understand that as a board-governed school, Trinity encourages and relies upon the active involvement of parents. I/we also recognize that in order to operate it is necessary for Trinity to charge tuition and fees for each student enrolled, and that receipt of such tuition and fees on a timely basis is critical for Trinity to meet its financial obligations. I/we have reviewed the tuition and fee schedule for the 2011-2012 school year approved by the Trinity Governing Board, which has been provided to me/us along with this Agreement.
In consideration of the education to be provided to my/our child(ren) at Trinity and the understanding that I/we will be entitled to all the rights and privileges of the Trinity family, I/we acknowledge and agree as follows:
1. It is my/our obligation to pay to Trinity the full tuition as set forth in Section 8 of this agreement, and any additional fees and charges for special activities and programs in which my/our children may participate during the entire school year. Recognizing that the majority of Trinity’s expenses and obligations are incurred on an annual basis and do not diminish by the departure of students during the school year, I/we agree that if I/we have not cancelled the enrollment of my/our child(ren) on or before May 1, 2011, I/we will be responsible to pay the full year’s tuition and fees. Further, I/we agree that, after that date, Trinity will not be required to refund payments or cancel unpaid obligations for any reason regardless of my/our child(ren)’s withdrawal, dismissal or absence from Trinity.
2. Tuition is due and payable in full on July 1, 2011; however, if I/we elect to pay tuition in installments, all installment payments are due and payable in full by the first of each month. If any payment becomes more than twenty days past due, my/our child(ren) will not be permitted to attend classes, or participate in any school or extra-curricular activities (including sports, Christmas performances, orchestra, etc.) until such account is brought to a less than twenty day past due status.
3. In order for a student to be admitted to class on the first day of school, all past due accounts for the prior school years plus the full tuition (or, if I/we elect installment payments, the July installment payment) and consumables fee for the present year must be paid. In addition, in order for a student to return to class after both Christmas and Easter break, all accounts must be current.
4. I/we understand that in addition to my/our financial obligations, my/our continued involvement in the mission of Trinity, as well as our support of the Trinity Governing Board, is critical to its success. Accordingly, as part of my/our commitment to be actively involved, I/we agree to comply with the Partnership Agreement provided to us.
5. I/we agree to comply, and to cause my/our child(ren) to comply, with all of the requirements of parents and students set forth in the Trinity Student-Parent Handbook
6. I/we acknowledge that many different Christian churches are represented at Trinity and in its ministries. As a part of my/our commitment to the mission of Trinity, I/we agree to respect and honor, in word and deed, the churches other than my/our own and the families who belong to them. I/we further agree not to introduce congregational or denominational issues into the culture of Trinity.
7. I/we am/are (a) Christian(s) and believe that the Bible commands me/us to make every effort to live at peace and to resolve disputes with any other believer in private or within the Christian community in conformity with the Biblical injunctions of I Corinthians 6:1-8, Matthew 5:23-24 and Matthew 18:15-20. Therefore, I/we agree, on my/our behalf and on behalf of my/our child(ren) enrolled at Trinity, that any claim, controversy or dispute arising out of, or related to, this agreement or any aspect of my/our and/or my/our child(ren)'s relationship with Trinity, including any legal, equitable, statutory or other claims, which cannot be resolved as provided in the previous sentence, shall be settled by Biblically-based mediation in accordance with the Rules of Procedure for Christian Conciliation of the Institute for Christian Conciliation as printed in the Christian Conciliation Handbook (the “Rules”), a copy of which will be made available to me/us.
If resolution of the dispute and reconciliation do not result from such efforts, the matter shall then be submitted to a panel of three arbitrators for binding arbitration. The selection of the arbitrators and the arbitration process shall be conducted in accordance with the Rules. Regardless of the outcome of the matter, I/we agree to bear the fees and costs of my/our own arbitrator and one-half of the fees and costs of the neutral arbitrator and any other arbitration expenses.
I/we agree that these methods of Christian conciliation shall be the sole and exclusive remedy for any claim, controversy or dispute relating to or arising out of this agreement or any aspect of my/our and/or my/our child(ren)'s relationship with Trinity, and I/we expressly waive any right I/we or my/our child(ren) may have to file a lawsuit or any other type of charge against Trinity, its directors, officers, employees, or agents in any civil court, administrative agency, or other governmental forum for such claims, controversies or disputes, except to enforce a legally binding arbitration decision. I/we understand that, under the terms of Trinity Student-Parent Handbook, Trinity is obligated to abide by the foregoing Christian conciliation procedures.
The foregoing conciliation procedures shall not apply to any criminal action, proceeding or investigation initiated by any governmental authority.
